OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.  A purchase will not increase your chances of winning.  This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram or Facebook.  Any information provided is being provided to the Sponsor and not Instagram or Facebook.

These Official Rules govern the American Rag #MyAustinMoment Instagram Sweepstakes (the “Sweepstakes”) offered by Macy’s Merchandising Group, Inc. (“Sponsor”).  One Prize will be awarded.  Sweepstakes begins at 12:01 a.m. ET on March 13, 2013 and ends at 11:59 p.m. ET on March 16, 2013 (the “Sweepstakes Period”). 

To enter: To enter the Sweepstakes, entrant first needs to have the Instagram application downloaded on their mobile device and to become a registered user.  Accounts on Instagram are free. On Instagram you must follow Macy’s American Rag account (@raggedmag). Before entering the Sweepstakes, the “Photos Are Private” option in the account settings on your Instagram account must be set to “OFF”. To enter the Sweepstakes upload a photo of your experience in Austin, Texas anytime during SXSW 2013. In the caption for the image include the hashtag “#myaustinmoment”. All photos submitted according to the Official Rules along with the proper hashtag will be deemed an “entry”. All entries must comply with these Official Rules, including, without limitation, the “Entry Requirements” section below. All entries must be submitted during the Sweepstakes Period. Entries will not be acknowledged or returned. 

In the event of a dispute over the identity of any potential winner, the entry will be declared made by the authorized account holder of the account used for entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her email or postal address during the Sweepstakes Period. Proof of uploading an entry does not constitute proof of delivery or entry. All entries become the property of Sponsor and will not be returned to entrant.

Entry Requirements: To be eligible, entry must: (1) be in keeping with Sponsor’s image; (2) may not be obscene, indecent, or otherwise offensive (as determined by Sponsor in its sole discretion); (3) not defame or invade the publicity or privacy rights of any person, living or deceased; (4) infringe, violate, or misappropriate any person’s or entity’s personal or proprietary rights (including copyrights, trademarks, or other intellectual property rights); (5) not contain (i) any words, statements, or images considered offensive to individuals of any age, race, ethnicity, national origin, religion, sexual orientation, or other protected class, or who are disabled, (ii) any threats to any person, place, business, group, or entity, (iii) materials that promote bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on age, race, ethnicity, national origin, religion, sexual orientation or other protected class, or disability, (iv) any materials that depict illegal acts, are sexually explicit, libelous, obscene, violent, hateful, slanderous, (v) content not in keeping with Sponsor’s reputation and image or (6) adhere to the Instagram Terms of Use set forth here http://instagram.com/about/legal/terms/ and (7) not be owned by a third-party and/or be subject of or to any restriction or right that would in any way limit Sponsor’s right to use the entry as permitted under these Official Rules (collectively “Entry Requirements”). Failure to comply with these Entry Requirements, as determined by Sponsor in its sole discretion, is grounds for an automatic disqualification from the Sweepstakes.

Limit of ten (10) entries per person per day during the Sweepstakes Period will be accepted.  Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified.  Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes, at Sponsor’s sole and absolute discretion. 

Eligibility:  Sweepstakes is open to legal residents of the United States, the District of Columbia and Puerto Rico who are 18 years of age or older as of the date of entry, except employees of Sponsor, Administrator and their affiliates, subsidiaries, advertising and promotion agencies and the immediate family members and/or those living in the same household of each such employee.  Sweepstakes is void where prohibited by law.

Drawing. One (1) Grand Prize winner and two (2) Runner Up winners will be selected in a random drawing on or about March 29, 2013.  All decisions of the judges are final.  Odds of winning will be determined by the number of eligible entries received.  Prize consists of only those items specifically described as included in the prize.  All fees, federal, state and other taxes, costs and expenses relating to the use, acceptance and possession of the prize are the sole responsibility of the winner.

Prizes:  Grand Prize Winner will receive a $500 Macy’s Gift Card.  Runner Up winners will each receive a $50 Macy’s Gift Card.  Approximate Retail Value (ARV) of all Prizes: $600. 

Notification:  Sponsor will contact potential winner by posting a comment from @raggedmag to the potential winner’s photo entry with instructions to contact Sponsor to begin the process of eligibility verification, prior to prize claim.  All instructions provided by Sponsor must be correctly followed and completed within the time period indicated in such notification.  Noncompliance within any of the time periods will result in disqualification without further notice and an alternate winner will be selection.  Such instructions will require the potential winner to post specified information on Instagram and correspond with Sponsor via the email address provided.  ALL ENTRANTS ARE ADVISED TO MONITOR THEIR INSTAGRAM ACCOUNTS ON THE DRAWING DATE AND REGULARLY THEREAFTER IN ORDER TO RECEIVE NOTICES TIMELY. SPONSOR WILL NOT BE RESPONSIBLE FOR ANY POTENTIAL WINNER’S FAILURE TO RESPOND WITHIN THE REQUISITE TIMEFRAME.  If a potential winner does not timely respond or if prize or prize notification is returned as undeliverable, potential winner will be disqualified and an alternate potential winner will be selected.  Upon prize forfeiture, no payment or other compensation will be made to the original potential winner.  Recipient of such notification (parent/legal guardian if potential winner is a minor in his/her state of residence)  must sign and return an affidavit of eligibility, liability and publicity release within fourteen (14) days of acceptance or an alternate potential winner may be selected.  Also, because the approximate retail value of the prize is $600 or more, a Social Security Number or Individual Taxpayer Identification Number is required to be provided to Sponsor for issuance of a 1099 Form.  In the event that a potential winner is disqualified for any reason, Sponsor will award the prize to an alternate winner by random drawing from among all remaining entries.  There will be three (3) alternate drawings. After the third such drawing, the prize will remain unawarded.  In the event of noncompliance with any requirement, the non-complying potential winner will be disqualified.  No substitution, exchange or transfer of prize except by Sponsor, in which case a prize of equal or greater value will be substituted. 

Release.  By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, including the interpretation of these Official Rules and its exercise of discretion, which will be final and binding in all respects.  Entrants are solely responsible for their own actions and agree to hold harmless Sponsor, Administrator and their respective parent, subsidiaries, divisions and related companies, together with and the respective officers, directors, employees, agents, successors, assigns and licensees of each of them, and those companies supplying prizes (collectively the “Released Parties”) from any liability for losses, damages or injuries arising in connection with their participation in the Sweepstakes or the award or use of a prize. 

Publicity & License.  Acceptance of a prize constitutes consent to Sponsor’s use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, (including but not limited to internet and television broadcast) without further consent or compensation except where prohibited.  Uploading an entry constitutes an entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, creative, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the entry.

General Conditions.  Sponsor and each of its affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; any error, omission, interruption, defect or delay in operation or transmission of any Sweepstakes-related website; failure of any entry to be received by Sponsor due to technical problems or human error; printing or other errors.  Sponsor reserves the right to modify, suspend or terminate the Sweepstakes in the event that it becomes necessary due to circumstances beyond Sponsor’s control.  In the event the Sweepstakes is terminated early, a potential Winner will be selected from all eligible entries received at the time of termination. 

Disputes.   The Sweepstakes is governed by the laws of the United States and, by entering, Winner and entrants hereby submit to the jurisdiction and venue of the federal, state and local courts located in New York, New York.  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE RELATED TO SPONSOR OR THE SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW

Privacy.  Handling of all participant information, including e-mail addresses, will be consistent with the Macy’s Inc. Notice of Privacy Practices. See http://www.macys.com/service/start/safeshopping/privacy.jsp.
